If you have suffered an injury as the result of someone else's mistakes, then you will probably have many questions running through your mind, such as: How are you going to pay for medical expenses? How will you cope if you cannot return to work? And is there anything you can do? This article explores these questions, providing details on the different options available to you.

What Is A Personal Injury?

A personal injury is when someone sustains an injury which was caused due to the actions (or inaction) of another party. This may be an individual or an organisation (such as a local authority or an employer).

For example, a driver that runs into the back of another car will be held liable for the accident, making him/her responsible for any injuries suffered by the other party (be it the driver or the passengers). These injuries can be physical and/or psychological, and can be long-term or short-term.

Personal Injury - What Action Can You Take?

So if you have experienced a personal injury and you believe it to be the fault of someone else, what action you can take?

1. Follow the necessary procedures.

The first thing to remember is that personal injuries can arise in a number of ways, all of which will require different protocol to be followed. So if you have been involved in a road traffic accident, you should seek medical care, contact your insurance company and (if appropriate) contact the police. Alternatively, if you have sustained an injury at work, be sure to record it in the company's accident handbook.

However, once these steps been completed, you may want to explore taking further action:-

It is likely you will feel upset about your accident and wonder why it happened. If so, you may want to consider making a complaint For example, if you have tripped over a raised paving slab, you could make an official complaint to the authority responsible for the pavement's upkeep. You should then be given an explanation in writing as to why your accident happened and how the problem is to be remedied. Nevertheless, many find the process long and time-consuming, often resulting in little more than an apology.

3. Take legal action.

It may be possible for you to take legal action over your personal injury. If you are contemplating this as an option, you need to speak to a lawyer. A solicitor specialising in personal injury will be able to assess the nature of your case, advising you whether or not it is possible to pursue a claim.

Should your claim be successful, you will be awarded a sum of compensation to recompense for the pain and suffering you have experienced, as well as any financial losses that have occurred because of the accident (for example, loss of earnings).
