Motorcyclists are particularly vulnerable road users, with other motorists, pedestrians, weather conditions and road surfaces all potential hazards. And with such little protection, motorcyclists and their passengers are substantially more at risk than other road users. In fact, it is considered that a motorcyclist is 40 times more likely to suffer a fatal injury than a car driver.

There are, therefore, a number of ways a motorcycle accident can happen. Some of the most common types of motorcycle accident we see involve:-

* Junctions - eg. when a motorist pulls out in front of a motorbike;

* Filtering - eg. when a motorist does not notice a motorbike edging along the inside of slow-moving traffic;

* Overtaking - eg. when a vehicle tries to overtake a scooter or moped;

* Roundabouts - eg. when a motorist exists a roundabout or changes lane without noticing a motorbike;

* Poor road surface - eg. potholes;

* Diesel spills - eg. from a vehicle which has neglected to secure the fuel cap;

* Pedestrians - eg. when a pedestrian fails to look properly and steps out into oncoming traffic.

What If The Accident Was Not Your Fault?

But what happens if responsibility for your motorcycle accident lies with another party? Can you make a claim as you would with any other type of road traffic accident?

The simple answer is yes, if you have been injured in a motorbike accident that was not your fault, you could be entitled to make a claim. Whether you were the driver or the pillion, you need to seek expert legal advice regarding your injuries.

A personal injury solicitor will be able to assess your case and quickly suggest whether or not you have the grounds to make a claim. If so, you will need to prove that liability lies with the other side. In order to do so, it helps if you note down the details of the incident while they are fresh in your mind, take names and contact details of witnesses, and if possible take photos of site of the accident.

As long as liability can be proved, you will certainly be able to claim compensation for the pain and suffering you have experienced because of the accident. You will also be able to recover any financial losses incurred, such as the expense of damaged clothing, motorbike or motorcycle repairs and a loss of earnings.
